Thanks for the insight - I'll be discussing some modifications to the TOS
with the other involved parties tomorrow to see if we can't make it a little
less menacing.

You know I actually signed up a few days ago, and looked around.
While I thought the "delete account" thing was pretty drastic, I sort
of understood the need to be able to remove idiots fast and without
fanfare or wasted time, I mean, lets face it, it's $1 month, people
can't expect you to waste time on something like this if they are
simply exploiting your server.

However, the deal breaker for me was actually other parts of the TOS:

3.5 - If prior to the end of the agreed on Term, Customer cancels
the Services for any reason, or WHU terminates the Agreement
due to Customer's breach of the WHU User Agreement or Acceptable
Usage Policy, Customer will be charged a US$150.00 Breach-Of-Contract
fee per domain package and per hosting account as liquidated damages.

uhhhhhh isn't that like 12 and a half years of hosting at the $1 month rate
????

Section 3.6, 3.7, 3.8, 3.9 and the late fee charges in 4.1 all give me
pause as well....

3.7 - All sales are final. Any cancellation requests sent to or
directed to WHU by
email and/or regular mail shall be null and void. Customer also agrees that
any
request for a refund shall be forfeited.

uhhhhhh ok, HOW do you cancel then ???

and in section

4.2 - Customer agrees that WHU may charge up to 30 days in advance all fees
due
for the Services provided to Customer under this agreement to the
credit card supplied
by Customer during registration or at any time thereafter and customer
specifically
agrees not to charge back any payments WHU processes through Customer's
credit
card, checking account or other form of payment on file with WHU.

I don't know, seems like alot of charges/penalties/rules etc for a $12
year hosting account.....
I'm not trying to pick this apart, I'm just pointing out what I saw
and what others that read
the TOS are going to see, and how they will interpret it. I can't for
the life of me figure out
why I would subscribe to a TOS that could potentially charge me $150
for a $12 /yr account
and wants the authority to charge my payment method 30 days in advance
of the renewal date
and has the right to refuse any refunds, but I only have to renew
within 15 days. Also, it appears
that in the Tos you reserve the right to "upgrade" accounts 4 times a
year, and charge for them automatically
if someone doesn't object within 30 days of the upgrade .......

I'd be MUCH more inclined to use the service and promote it, if the
TOS didn't scare me off.
Excellent idea, tos ...not so much.
